В статье я анализирую ст. 235.2 УК РФ, введенную Федеральным законом от 10 июня 2026 г. № 164-ФЗ и устанавливающую ответственность за подделку и оборот поддельных официальных документов об отсутствии заболеваний, представляющих опасность для окружающих. На основе пояснительной записки к законопроекту, законодательства о медицинском освидетельствовании иностранных граждан, разъяснений Пленума Верховного Суда РФ и судебной практики по ст. 327 УК РФ я выявляю проблемы квалификации. Я показываю, что связь нормы с перечнями заболеваний установлена лишь законопроектными материалами, а разграничение частей 1 и 2 не согласуется с медицинским содержанием понятий. Я обосновываю телеологическое ограничение предмета по ч. 1, определяю значение электронного медицинского заключения и очерчиваю круг документов, не охватываемых нормой. Предлагаю критерий отграничения преступления от административного правонарушения по ст. 18.21 КоАП РФ – создание завершенного официального документа, заведомо ложно удостоверяющего проведение конститутивной медицинской процедуры и ее результат. Кроме того, я выявляю противоречия в обосновании субъективной стороны особо квалифицированного состава и рассматриваю соотношение со ст. 292 и 322.1 УК РФ.

In this article I analyse Article 235.2 of the Criminal Code of the Russian Federation, introduced by Federal Law No. 164-FZ of 10 June 2026, which establishes liability for forgery and circulation of forged official documents certifying the absence of diseases dangerous to others. Based on the explanatory note to the draft law, legislation on medical examination of foreign citizens, explanations of the Plenum of the Supreme Court and case law under Article 327 of the Criminal Code, I identify problems of qualification. I show that the link between the provision and the lists of diseases is established only by legislative materials, and the distinction between Parts 1 and 2 is inconsistent with the medical meaning of the concepts. I substantiate a teleological narrowing of the subject of the crime under Part 1, determine the significance of the electronic medical conclusion and outline the documents not covered by the provision. I propose a criterion for distinguishing the crime from the administrative offence under Article 18.21 of the Code of Administrative Offences: the creation of a completed official document knowingly falsely certifying the performance and result of a constitutive medical procedure. I also reveal contradictions in the justification of the mental element of the especially aggravated offence and consider the relationship with Articles 292 and 322.1 of the Criminal Code.
