В статье исследуются организационно-правовые основы прокурорского надзора за соблюдением некоторых прав и свобод военнослужащих, в том числе в период проведения специальной военной операции. Особое внимание уделено правовому положению военнослужащих, находящихся в плену, удерживаемых в качестве заложников, интернированных либо отсутствующих по месту прохождения военной службы, а также механизму реализации социальных гарантий членов их семей.

The article examines the organizational and legal foundations of military prosecutor’s supervision over the observance of the rights and freedoms of military personnel. Particular attention is paid to the legal status of military personnel who are in captivity, held hostage, interned or missing, as well as to the implementation of social guarantees for their family members. The subject, limits and principal directions of supervision are analyzed on the basis of constitutional provisions and legislation governing the prosecutor’s office, the status of military personnel, monetary allowances and social support. The article substantiates the conclusion that military prosecutor’s supervision in this sphere has a comprehensive, rights-protective, restorative and preventive character.
