<p>The question of whether a specific individual possesses "specialized knowledge"—and the criteria for distinguishing such knowledge from common, generally accessible knowledge—along with the scope of authority granted to "specialists" and "experts" in criminal proceedings, has been a subject of debate for decades. A central element of this discussion concerns the expert’s report and its evaluation as evidence. The author examines the evolution of the approach within criminal procedure regarding the admissibility of involving knowledgeable individuals to assist in assessing the scientific reliability of such reports. Analyzing the current conflict between the law and the scientific community, the author concludes that the judicial community effectively opposes the involvement of specialists in this capacity. Existing legislation not only fails to foster the adversarial principle but remains, in essence, unchanged from its previous iteration. The formal inclusion of a specialist’s testimony and reports in the law—elevating them from the category of "other evidence" to a distinct evidentiary status—has been rendered largely ineffective. This is due to a lack of corresponding revisions to the Criminal Code and the Code of Criminal Procedure regarding the criteria for qualifying an individual as a "specialist," the scope of their authority to assist defense counsel, investigators, or the court in evaluating the scientific reliability of an expert’s report, and the issue of a specialist’s criminal liability for providing a knowingly false opinion. Furthermore, the author explores how investigators and courts assess the scientific reliability of expert reports, arguing that both specialists and experts should be permitted to participate in this process—a position supported by examples from forensic practice.</p>
<kwd-group xml:lang="ru"><kwd>специальные знания</kwd><kwd>судебный эксперт</kwd><kwd>специалист</kwd><kwd>принцип состязательности сторон</kwd><kwd>оценка заключения эксперта</kwd><kwd>дополнительная и повторная экспертизы</kwd></kwd-group><kwd-group xml:lang="en"><kwd>specialized knowledge</kwd><kwd>forensic expert</kwd><kwd>specialist</kwd><kwd>adversarial principle</kwd><kwd>evaluation of an expert’s report</kwd><kwd>supplementary and repeat forensic examinations</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">[1] Владимиров Л. Е. – 236 с.</mixed-citation></ref><ref id="ref2"><mixed-citation publication-type="other" xml:lang="ru">[2] Эйсман А.А.
