<p>The article examines the limits of admissibility of trial in absentia in Russian criminal proceedings and the guarantees of the defendant’s right to defence associated with this procedural form. The relevance of the study is determined by the fact that hearing a criminal case in the absence of the defendant affects one of the most important elements of a fair trial: the person’s ability to participate personally in the proceedings, give explanations, object to the accusation, file motions and influence the examination of evidence. The author proceeds from the idea that trial in absentia should not be treated as an ordinary procedural simplification, since the absence of the defendant objectively weakens the immediacy of judicial examination and the adversarial activity of the defence. Therefore, a higher standard for verifying the conditions for applying this procedure is required. Particular attention is paid to the correlation between the concepts of trial in absentia, hearing a criminal case in the absence of the defendant and sentence in absentia, as well as to the analysis of parts 4 and 5 of Article 247 of the Criminal Procedure Code of the Russian Federation. The article concludes that the admissibility of trial in absentia should be assessed through a combination of criteria: legality of the ground, exceptional nature of the situation, proper notification of the defendant, proof of evasion, mandatory participation of defence counsel and an effective mechanism for subsequent review of the judgment.</p>
<kwd-group xml:lang="ru"><kwd>заочное судебное разбирательство</kwd><kwd>уголовный процесс</kwd><kwd>подсудимый</kwd><kwd>право на защиту</kwd><kwd>статья 247 УПК РФ</kwd><kwd>заочный приговор</kwd><kwd>состязательность</kwd><kwd>справедливое судебное разбирательство</kwd><kwd>судебный контроль</kwd><kwd>процессуальные гарантии</kwd></kwd-group><kwd-group xml:lang="en"><kwd>trial in absentia</kwd><kwd>criminal procedure</kwd><kwd>defendant</kwd><kwd>right to defence</kwd><kwd>Article 247 of the Criminal Procedure Code of the Russian Federation</kwd><kwd>sentence in absentia</kwd><kwd>adversarial principle</kwd><kwd>fair trial</kwd><kwd>judicial control</kwd><kwd>procedural guarantees</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">Конституция Российской Федерации: принята всенародным голосованием 12 декабря 1993 г. 1993. 25 декабря.</mixed-citation></ref><ref id="ref2"><mixed-citation publication-type="other" xml:lang="ru">Уголовно-процессуальный кодекс Российской Федерации от 18 декабря 2001 г. 2001. № 52 (ч.
