<p>The article provides a comparative legal analysis of the regulation of the labour of persons sentenced to imprisonment in Russia and the countries of Western Europe. The relevance of the topic stems from the reform of the penal enforcement system and the reorientation of penitentiary policy towards the resocialisation of convicts. The purpose of the study is to identify the common and distinctive features of national models of convict labour and to determine possible directions for improving Russian legislation. The methodological basis comprises the comparative legal method as the principal one, as well as the formal legal method, the systemic approach and the techniques of analysis and synthesis. It is established that no single Western European model of convict labour exists: compulsory labour of the German type coexists with the voluntary labour of Italy, Spain and France, which has abandoned the obligatory character of convict labour. The Russian model, which enshrines the obligation of paid labour, is closest to the German one, while the compulsory nature of convict labour does not contradict the constitutional prohibition of forced labour or the international obligations of the Russian Federation. It is shown that the remunerated character of labour is recognised in all the legal orders examined, whereas the method of determining the amount of payment and the degree of social insurance protection of working convicts differ substantially. Particular attention is paid to the question of introducing an employment contract with a convict in Russia by analogy with the French penitentiary employment contract; the conclusion is substantiated that the contractual form is incompatible with the compulsory nature of convict labour. The author concludes that it is expedient to selectively strengthen labour law guarantees within penal enforcement legislation, including the extension of social insurance for working convicts, without introducing a special chapter on convict labour into the Labour Code of the Russian Federation.</p>
<kwd-group xml:lang="ru"><kwd>труд осужденных</kwd><kwd>лишение свободы</kwd><kwd>принудительный труд</kwd><kwd>сравнительное правоведение</kwd><kwd>пенитенциарные системы</kwd><kwd>уголовно-исполнительное право</kwd><kwd>страны Западной Европы</kwd><kwd>трудовой договор</kwd><kwd>ресоциализация</kwd><kwd>оплата труда осужденных</kwd></kwd-group><kwd-group xml:lang="en"><kwd>convict labour</kwd><kwd>imprisonment</kwd><kwd>forced labour</kwd><kwd>comparative law</kwd><kwd>penitentiary systems</kwd><kwd>penal enforcement law</kwd><kwd>countries of Western Europe</kwd><kwd>employment contract</kwd><kwd>resocialisation</kwd><kwd>remuneration of convict labour</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">[1] Нурбаев, М. С. – 2014. – № 2(13). – С. 20-24.</mixed-citation></ref><ref id="ref2"><mixed-citation publication-type="other" xml:lang="ru">[2] Уткин, А. В. – 2024. – № 2(59). – С. 94-105.</mixed-citation></ref><ref id="ref3"><mixed-citation publication-type="other" xml:lang="ru">[3] Тюфяков, Н. А. – 2017. – № 3(70). – С. 55-60.</mixed-citation></ref><ref id="ref4"><mixed-citation publication-type="other" xml:lang="ru">[4] Тепляшин, П. В. 2016. № 1(26). – С. 87-97.</mixed-citation></ref><ref id="ref5"><mixed-citation publication-type="other" xml:lang="ru">[5] Шилова, Н. П. – 2009. – № 5. – С. 78-84.</mixed-citation></ref><ref id="ref6"><mixed-citation publication-type="other" xml:lang="en">[1] Nurbaev, M. S. Labor of convicts in places of deprivation of liberty: right or duty ?/M. S. Nurbaev // Bulletin of the Samara Law Institute. – 2014. – № 2(13). - S. 20-24.</mixed-citation></ref><ref id="ref7"><mixed-citation publication-type="other" xml:lang="en">[2] Utkin, A.V. Labor of those sentenced to imprisonment as a subject of intersectoral regulation/A.V. Utkin // Bulletin of the Kuzbass Institute. – 2024. – № 2(59). - S. 94-105.</mixed-citation></ref><ref id="ref8"><mixed-citation publication-type="other" xml:lang="en">[3] Tyufyakov, N. A. Change in the type of correctional institution for those sentenced to imprisonment in the penitentiary law of foreign countries/N. A. Tyufyakov // Psychopedagogy in law enforcement agencies. – 2017. – № 3(70). - S. 55-60.</mixed-citation></ref><ref id="ref9"><mixed-citation publication-type="other" xml:lang="en">[4] Teplyashin, P.V. German type of European penitentiary systems/P.V. Teplyashin // Bulletin of the Kuzbass Institute. 2016. № 1(26). - S. 87-97.</mixed-citation></ref><ref id="ref10"><mixed-citation publication-type="other" xml:lang="en">[5] Shilova, N.P. Features of the labor of persons sentenced to imprisonment/N.P. Shilova // Bulletin of the Institute: crime, punishment, correction. – 2009. – № 5. - S. 78-84.</mixed-citation></ref></ref-list></back></article>
