Статья посвящена вопросам правового режима обеспечения конфиденциальности сведений о происхождении ребенка в контексте усыновления и применения вспомогательных репродуктивных технологий (ВРТ). Автор исследует коллизию между правом человека на личную тайну и правом ребенка на знание своих биологических родителей. Особое внимание уделяется уголовно-правовой охране тайны усыновления (ст. 155 УК РФ) и защите частной жизни (ст. 137 УК РФ) применительно к суррогатному материнству и донорству гамет. Делается вывод о необходимости оптимизации законодательства в условиях цифровизации и доступности генетического тестирования.

This article examines the legal framework for ensuring the confidentiality of information about a child’s origin in the context of adoption and the use of assisted reproductive technologies (ART). The author explores the conflict between a person’s right to privacy and a child’s right to know their biological parents. Particular attention is paid to the criminal protection of adoption secrecy (Article 155 of the Criminal Code of the Russian Federation) and the protection of privacy (Article 137 of the Criminal Code of the Russian Federation) as they apply to surrogacy and gamete donation. The article concludes that legislation needs to be optimized in the context of digitalization and the availability of genetic testing.
