Целью исследования является обоснование формирования системы международных договоров в области иностранных инвестиций в разработку и внедрение инноваций. В инвестиционных правоотношениях, где объектом инвестиций выступает инновация, иностранный инвестор сталкивается с дополнительными инвестиционными рисками ввиду особого характера объекта инвестиций. Отсутствие единообразного подхода на универсальном уровне, а также противоречия в подходах национальных законодательств к регулированию инвестиционных отношений и интеллектуальной собственности негативно сказывается на общем инвестиционном климате и уровне правовой защиты, в частности, прав иностранного инвестора. При отсутствии правовой защиты инновации как объекта иностранных инвестиций исключается возможность применения механизмов защиты интеллектуальной собственности, что в свою очередь приводит к невозможности реализации положений международных договоров о защите иностранных инвестиций. В связи с чем, именно системное применение международных договоров в области иностранных инвестиций и интеллектуальной собственности создает условия для комплексной защиты инвестиций и инноваций и способствует технологическому развитию.

The purpose of this research is to substantiate the formation of a system of international treaties in the field of foreign investment in the sphere of development and implementation of innovation. In investment legal relations, where innovation serves as the object of investment, a foreign investor faces additional investment risks due to the specific nature of investment object. The lack of a uniform approach at the universal level, as well as contradictions in the approaches of national legislation regarding the regulation of investment relations and intellectual property, negatively affects the overall investment climate and the level of legal protection, particularly the rights of foreign investors. In the absence of legal protection for innovation as an object of foreign investment, the possibility of applying intellectual property protection mechanisms is excluded. This, in turn, leads to the impossibility of implementing the provisions of international treaties on the protection of foreign investment. Therefore, it is the systematic application of international treaties in the field of foreign investment and intellectual property that creates conditions for comprehensive protection of investments and innovations and contributes to technological development.
