Turkmenistan, South American Silver v. Bolivia, Tennant Energy v. Canada, IC Power and Kenon v. Peru и RSM v. Saint Lucia.
<p>The article examines the limits of disclosure of third-party funding in international investment arbitration. The issue has become particularly relevant as the debate has shifted from the admissibility of funding to the design of procedural safeguards protecting arbitrator independence, equality of arms and confidential commercial information. The study aims to substantiate a proportionate disclosure model that distinguishes the minimum identification of a funder from exceptional disclosure of the funding agreement. The research applies doctrinal and comparative legal methods, case‑law analysis and legal modelling. It considers the 2024 IBA Guidelines on Conflicts of Interest, the 2022 ICSID Arbitration Rules, the work of UNCITRAL Working Group III and procedural orders in Muhammet Çap v. Turkmenistan, South American Silver v. Bolivia, Tennant Energy v. Canada, IC Power and Kenon v. Peru and RSM v. Saint Lucia. The article argues that baseline disclosure should cover the existence of funding, the funder's identity and address and, where an intermediary vehicle is used, the person effectively controlling the funding. Contractual terms should be disclosed only where the requested information has a proven connection with conflicts of interest, allocation or security for costs, or control over procedural strategy. A three-tier disclosure model is proposed: automatic minimum disclosure, targeted disclosure of procedurally relevant terms and exceptional broader disclosure of the funding agreement. The study concludes that a mixed regulatory model is preferable: soft law should formulate the standard, institutional rules should make it procedurally binding, and hard law should be confined to minimum guarantees.</p>
<kwd-group xml:lang="ru"><kwd>финансирование третьей стороной</kwd><kwd>инвестиционный арбитраж</kwd><kwd>раскрытие информации</kwd><kwd>конфликт интересов</kwd><kwd>обеспечение расходов</kwd><kwd>конфиденциальность</kwd><kwd>мягкое право</kwd><kwd>МЦУИС</kwd><kwd>ЮНСИТРАЛ</kwd><kwd>пропорциональность</kwd></kwd-group><kwd-group xml:lang="en"><kwd>third-party funding</kwd><kwd>investment arbitration</kwd><kwd>disclosure</kwd><kwd>conflicts of interest</kwd><kwd>security for costs</kwd><kwd>confidentiality</kwd><kwd>soft law</kwd><kwd>ICSID</kwd><kwd>UNCITRAL</kwd><kwd>proportionality</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">[1] Захаров А., Савельева Е.
