<p>The article addresses the problem that public international law faces when attempting to provide a legal definition of artificial intelligence. In the technical sciences, there is still no consensus on the understanding of this phenomenon. The absence of a universally recognized scientific definition creates a situation for law in which the technology must be regulated, yet there is no established knowledge to rely on. Through a comparative legal and formal-legal analysis of key international instruments, the author demonstrates a consistent departure from attempts to define the essence of artificial intelligence. Instead, a functional approach is being established, whereby legal norms begin to describe not what artificial intelligence is by its nature, but rather how it operates and what risks it generates. Concurrently, there is a conscious reliance on soft law instruments and the precautionary principle. Such instruments do not have binding force, but they shape value orientations and over time may evolve into hard norms. This flexibility allows the law to respond in a timely manner to technological changes, without waiting for a final resolution of scientific disputes. The result is an adaptive legal regulation that acknowledges the limits of currently available knowledge while simultaneously providing the necessary level of control over rapidly developing technologies.</p>
<kwd-group xml:lang="ru"><kwd>искусственный интеллект</kwd><kwd>международное публичное право</kwd><kwd>правовая неопределенность</kwd><kwd>мягкое право</kwd><kwd>функциональный подход</kwd></kwd-group><kwd-group xml:lang="en"><kwd>artificial intelligence</kwd><kwd>public international law</kwd><kwd>legal uncertainty</kwd><kwd>soft law</kwd><kwd>functional approach</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">[1] Барбашова Е. В. - № 4 – С. 96 – 106.</mixed-citation></ref><ref id="ref2"><mixed-citation publication-type="other" xml:lang="ru">[2] Добычина Н.В. - № 2 – С. 97 – 103.</mixed-citation></ref><ref id="ref3"><mixed-citation publication-type="other" xml:lang="ru">[3] Степаненко А.С.
