<p>The article examines the implementation of artificial intelligence technologies in public audit through the discrepancy between the legal principle of good faith and the logic of algorithmic systems. The author notes that automatic decision-making based on anomaly detection and probability assessment of future violations may infringe the rights of audited entities. The central question is to determine the legal force of AI-generated conclusions and their use as a basis for initiating administrative proceedings. A comparative legal analysis examines three national models. The Russian approach assigns to AI the role of an analytical tool with no evidentiary value, any decision being subject to mandatory verification by an official. The Chinese model demonstrates a trend toward granting algorithmic predictions increasing legal significance, inspectors being obliged to respond to system signals, and the subject of rebuttal becoming statistical anomalies rather than established facts. Indian practice reveals significant differences in legal regulation across states, and AI-based decisions are frequently challenged in courts. The author concludes there is no universal way to resolve the conflict between the efficiency of predictive AI audit and guarantees of audited entities’ rights. Prospects for a unified BRICS standard are limited due to states’ commitment to digital sovereignty and differences in ethical standards; however, convergence at the level of recommendatory norms and general principles is possible.</p>
<kwd-group xml:lang="ru"><kwd>искусственный интеллект</kwd><kwd>цифровая трансформация</kwd><kwd>государства БРИКС</kwd><kwd>управление рисками</kwd><kwd>презумпция добросовестности</kwd><kwd>этические стандарты</kwd><kwd>предикативная аналитика</kwd><kwd>государственный аудит</kwd><kwd>сравнительное правоведение</kwd></kwd-group><kwd-group xml:lang="en"><kwd>artificial intelligence</kwd><kwd>digital transformation</kwd><kwd>BRICS states</kwd><kwd>risk management</kwd><kwd>presumption of good faith</kwd><kwd>ethical standards</kwd><kwd>predictive analytics</kwd><kwd>public audit</kwd><kwd>comparative law</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">Артыкбаев Б.
