<p>The article examines the legal status of clergy of the Russian Orthodox Church (ROC) engaged in pastoral ministry in the zone of the special military operation in 2022–2026. The scale of the Church’s presence in the combat zone proved unprecedented: more than 2,000 clergy members and over 4,500 deployment missions over three years. This scale exposed a systemic unpreparedness of existing legislation for a situation in which hundreds of clerics are regularly exposed to combat conditions without a defined legal status. Applying formal-legal and systemic methods, the study identifies three categories of military clergy: full-time assistant commanders for work with religious servicemen, non-staff volunteer clergy, and clergy who have entered into military service contracts. Each of these legal statuses emerged as a situational response to a specific practical need rather than as part of a coherent regulatory framework. This fragmentation, in itself, accounts for most of the legal conflicts identified, independently of the absence of framework legislation. An analysis of Presidential Decree No. 181 of 11 March 2024 and Order No. 123/13 of the Federal Agency for Youth Affairs and the Association of Volunteer Centers of 12 April 2024 demonstrates that subordinate regulation resolved the most acute gaps regarding lump-sum payments, yet left unaddressed the questions of clerical subordination in the combat zone and the canonical incompatibility of military serviceman status with holy orders. The expansive interpretation of Article 14 of the Constitution of the Russian Federation advanced by the Main Military-Political Directorate likewise remains unresolved, and law enforcement in this area continues to be unstable. Against this background, the development and adoption of amendments to military legislation and legislation on religious associations – specifically in the part concerning the legal status of military chaplains – appears to be a promising avenue for reform.</p>
<kwd-group xml:lang="ru"><kwd>Русская Православная Церковь</kwd><kwd>специальная военная операция</kwd><kwd>военное духовенство</kwd><kwd>военный капеллан</kwd><kwd>социальные гарантии</kwd><kwd>ветераны боевых действий</kwd><kwd>помощник командира</kwd><kwd>работа с верующими военнослужащими</kwd></kwd-group><kwd-group xml:lang="en"><kwd>Russian Orthodox Church</kwd><kwd>special military operation</kwd><kwd>military clergy</kwd><kwd>military chaplain</kwd><kwd>social guarantees</kwd><kwd>combat veteran</kwd><kwd>assistant commander</kwd><kwd>work with religious servicemen</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">Дорская А.А.
