В статье представлен теоретико-правовой анализ понятия «личность преступника» в отечественной криминологии, исследуется разграничение категорий «человек» и «личность», а также обосновывается условный характер данного термина, актуального лишь с момента совершения деяния, предусмотренного Уголовным кодексом РФ. Автор определяет личность правонарушителя как многоуровневую структуру социально-типичных признаков, биологических и психологических особенностей, сформированных под влиянием негативной среды и детерминирующих общественную опасность, подчеркивая необходимость применения принципа встречной детерминации для системной профилактики и ресоциализации.

The article presents a theoretical and legal analysis of the concept of the "offender's personality" within domestic criminology; it examines the distinction between the categories of "human being" and "personality" and substantiates the conditional nature of the term, which becomes relevant only upon the commission of an act defined by the Criminal Code of the Russian Federation. The author defines the offender's personality as a multi-level structure comprising socio-typical traits and biological and psychological characteristics—shaped by a negative environment and determining the act's social danger-while emphasizing the need to apply the principle of reciprocal determination for the purposes of systemic prevention and resocialization.
