В настоящей работе автор исследует исторический аспект развития процессуального порядка производства обыска в России. Им анализируется правовая природа, а также регламентация проведения указанного следственного действия в период XI-XIX вв. Объектом изучения являются такие нормативно-правовые акты, как Краткая редакция Русской Правды, Псковская судная грамота, Судебник 1497 г., Судебник 1550 г., Соборное Уложение 1649 г., Свод законов Российской империи 1832 г., Устав уголовного судопроизводства 1864 г.

This paper examines the historical development of the procedural framework governing searches in Russia. The author analyses the legal nature of this investigative measure and the rules governing its conduct from the eleventh to the nineteenth century. The study focuses on the following legal instruments: the Short Recension of the Russkaya Pravda, the Pskov Judicial Charter, the Sudebnik of 1497, the Sudebnik of 1550, the Sobornoye Ulozheniye of 1649, the 1832 Code of Laws of the Russian Empire, and the 1864 Statute of Criminal Procedure.
