<p>This article is devoted to a comparative legal analysis of the limits of the principle of autonomy of the will of the parties in contracts for the carriage of goods by sea under the law of Russia and England. The author explores the conceptual foundations of the autonomy of the will, dating back to Roman law, and the classification of imperative norms limiting it (ordinary and superimperative). The paper identifies key differences in the sources and mechanisms of restriction of contractual freedom: the English model of the "statutory imperative", based on the Hague-Visby Rules (COGSA 1971), is compared with the Russian model of "limited dispositivity", enshrined in the KTM of the Russian Federation and the Civil Code of the Russian Federation and assumes differentiation of the legal regime depending on the type of navigation (coasting or foreign). Particular attention is paid to the conflict‑of-laws aspects of the choice of applicable law, the incorporation of arbitration clauses, as well as the impact of sanctions regimes (decrees of the President of the Russian Federation, EU regulations) on the implementation of the autonomy of the will. The author comes to the conclusion that, despite the common goal of protecting the weak side of the contract, the approaches of the two jurisdictions fundamentally differ in substantive, conflict‑of-laws and procedural aspects, and sanctions regulation forms a new layer of imperative restrictions that block contractual freedom.</p>
<kwd-group xml:lang="ru"><kwd>автономия
